This Terms of Service agreement outlines the rules and guidelines for using Hyzer. By accessing or using our services, you agree to comply with this agreement. This agreement is governed by the laws of the United States.

Service Description

Our platform serves as a resource for disc golf enthusiasts, offering a range of features that allow for disc discovery, research, and community contribution.

Eligibility

Our services are intended for individuals over the age of 18. Minors may use the service only with the consent of a parent or guardian.

User Conduct

You are solely responsible for your conduct and any data, text, or other material that you upload to our platform.

User-Generated Content

By uploading content to Hyzer, you grant us a royalty-free, perpetual, irrevocable, non-exclusive, transferable, and sublicensable license to use, modify, reproduce, distribute, prepare derivative works of, display, and perform that content in connection with the service provided by Hyzer and across different media. This license continues even if you close your account or discontinue using our services. We also reserve the right to moderate or remove user-generated content at our discretion.

We may include affiliate links or third-party content on our platform. The presence of affiliate links does not influence the content, reviews, or recommendations made on our platform. We are not responsible for the content or practices of linked third-party sites.

No Warranties

We make no guarantees regarding the accuracy, reliability, or completeness of the information provided on our platform. Hyzer shall not be liable for any damages or losses resulting from the use or inability to use our services.

Dispute Resolution

Any disputes arising out of or related to these Terms of Service or our services will be resolved through arbitration, in accordance with the rules of the American Arbitration Association. The location for such arbitration shall be Pennsylvania, USA.

Account Termination

We reserve the right to issue warnings or terminate accounts at our sole discretion. Immediate termination may occur if deemed necessary. Upon termination, all data associated with the account may be deleted within 3 months. Public reviews and submitted disc data from terminated accounts may be retained, but any associated names will be removed.

Governing Law

This agreement and any dispute arising from it are governed by the laws of the State of Pennsylvania, United States.

Force Majeure

Neither party shall be liable for any failure or delay in performance under these Terms of Service for causes beyond that party's reasonable control and occurring without that party's fault or negligence, including, but not limited to, acts of God, natural disasters, war, or government mandates. For the duration of such event, this agreement and any obligations under it are suspended.

Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions of these Terms will remain in force.

Changes to These Terms

We may update these Terms of Service from time to time. It is your responsibility to review these Terms of Service periodically for changes. Changes are effective when posted on this page. In some jurisdictions where notification is required by law, we may notify users of changes.
